Most likely, the answer is no. The overwhelming majority of cases never reach the courtroom. According to the Bureau of Justice Statistics (BJS), only 3 percent of personal injury cases actually go to court.

During negotiations with Uber’s insurance company, there will be a back and forth with each side extending offers and counteroffers. At some point, the insurance company will issue its final take-it-or-leave-it offer. If the offer is unsatisfactory, you can appeal it through Uber’s internal appeal process, which may or may not result in a fair compensation settlement. You will not have to go to court during this appeal.

In rare cases, your case will end up in court. Even then, you will most likely not go to trial. Instead, the court will require you to exhaust all options before committing to a trial. A mediator may act as a third-party to oversee settlement negotiations.
